Welcome to Ocean Liquidation. These Terms & Conditions (“Terms”) govern your access to and use of our website located at oceanliquidation.com (“Website”) and all related services, including browsing our inventory, creating an account, and purchasing pallets, truckloads, and related wholesale merchandise (collectively, the “Services”). These Terms constitute a legally binding agreement between you (“you”, “buyer”, “customer”) and Ocean Liquidation (“we”, “us”, “our”).
By accessing our Website or placing an order with us, you confirm that you have read, understood, and agreed to be bound by these Terms in their entirety, together with our Shipping & Delivery Policy, Refund & Returns Policy, Condition & Grading Policy, and Privacy Policy, all of which are incorporated into these Terms by reference. If you do not agree with any part of these Terms, you must not use our Website or purchase from us.

2. Eligibility & Business Use
Our Website and Services are intended primarily for business customers, resellers, wholesalers, entrepreneurs, and organizations purchasing inventory for the purpose of resale, redistribution, or business use. While individuals may also purchase from us, by using our Website you represent and warrant that:
You are at least 18 years of age. You have the full legal capacity and authority to enter into a binding agreement, either on your own behalf or on behalf of a business entity you represent. You are not purchasing merchandise for personal, family, or household end-use in a jurisdiction where consumer protection laws would apply in a manner inconsistent with these Terms. You will use the purchased merchandise in compliance with all applicable federal, state, and local laws, including any import, export, resale, and licensing regulations applicable in your jurisdiction.
We reserve the right to refuse service to any individual or entity at our sole discretion. Certain consumer protection rights that apply to retail consumers may not apply to business-to-business transactions made through Ocean Liquidation.
3. Account Registration & Security
To place orders on our Website, you may be required to create a customer account. When registering, you agree to provide accurate, complete, and current information including your name, email address, phone number, and billing and shipping details. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.
You agree to notify us immediately at sales@oceanliquidation.com if you become aware of any unauthorized access to or use of your account. Ocean Liquidation will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials. We reserve the right to suspend or permanently terminate any account that provides false or misleading registration information, engages in fraudulent activity, violates these Terms, or misuses our Website or Services in any way.
4. Product Listings & Availability
Ocean Liquidation sells wholesale liquidation pallets and truckloads that may contain overstock merchandise, shelf pulls, customer returns, open-box items, tested units, and salvage goods, as described in each individual product listing and in accordance with our Condition & Grading Policy.
All product descriptions, photographs, manifests, estimated retail values, unit counts, and brand references provided in our listings are for general guidance purposes only. While we make every reasonable effort to provide accurate and transparent listing information, these details may not perfectly reflect the exact contents, brand mix, item proportions, or condition of every individual unit within a pallet, particularly for mixed-grade and unmanifested loads.
Ocean Liquidation reserves the right at any time and without prior notice to limit available quantities of any product, refuse or cancel any order, correct errors in product descriptions or pricing, withdraw any listing from sale, and substitute comparable inventory of equal or greater value when specific items become unavailable after an order has been placed. Listing availability is not guaranteed until payment has been received and confirmed.
5. Pricing, Payment & Taxes
All prices displayed on our Website are listed in United States Dollars (USD) unless otherwise explicitly stated. Prices are subject to change at any time before an order is confirmed and payment is received. The price applicable to your order is the price in effect at the time your payment is confirmed.
Ocean Liquidation accepts payment via the methods listed on our Website at the time of purchase. Currently accepted payment methods include wire transfer, and other methods as displayed at checkout. Accepted payment methods may be added, modified, or removed at any time. Payment must be received in full and confirmed as cleared before any order is processed, allocated, or prepared for shipment.
You are solely responsible for all applicable sales taxes, use taxes, import duties, customs fees, value-added taxes (VAT), and any other local, state, federal, or international levies applicable to your purchase based on your location and applicable law. Ocean Liquidation does not collect, withhold, or remit taxes on your behalf unless specifically required to do so under applicable law.
Ocean Liquidation reserves the right to request additional identity or payment verification for any order and to refuse or cancel orders we reasonably suspect to be fraudulent, abusive, or in violation of these Terms without liability to the buyer.
6. Order Confirmation & Acceptance
Placing an order on our Website constitutes an offer by you to purchase the selected merchandise under these Terms. An order is not accepted and no binding purchase contract is formed until Ocean Liquidation sends you a written order confirmation by email and payment has been received and verified. We reserve the right to decline any order for any reason, including but not limited to inventory unavailability, payment issues, suspected fraud, or delivery restrictions to your location.
In the event that an error in pricing, product description, or availability is identified after an order has been placed, Ocean Liquidation will notify you promptly. You will be given the option to proceed with the corrected order details or cancel your order for a full refund of the amount paid. We are not obligated to honor orders placed based on erroneous listing information.
7. Condition & Grading — AS-IS Liquidation
All merchandise sold by Ocean Liquidation is sold strictly AS-IS / WHERE-IS without any express or implied warranty as to the condition, functionality, completeness, merchantability, or fitness for any particular purpose, unless specifically and explicitly stated otherwise in an individual product listing.
Condition grades assigned to our pallets — including Brand New / Overstock, Shelf Pulls, Customer Returns, Mixed Grade, and Salvage — are applied in accordance with our Condition & Grading Policy and are intended as general descriptions of the predominant condition of the merchandise within a pallet. These grades do not guarantee the condition, functionality, or resale value of any individual item within a pallet. Minor variations in product mix, individual item condition, brand representation, and accessory inclusion are normal characteristics of liquidation merchandise and do not constitute grounds for a refund or return.
By purchasing from Ocean Liquidation, you confirm that you understand and accept the inherent variability and risk associated with buying wholesale liquidation inventory and that you have made your purchasing decision based on informed expectations consistent with the nature of the liquidation market.
8. Shipping & Delivery
All shipping and delivery of orders placed with Ocean Liquidation is governed by our Shipping & Delivery Policy, which is incorporated into these Terms by reference and available in full on our Website. As a summary, orders are typically processed within 2 to 4 business days after payment is confirmed and cleared. All pallets are shipped via LTL or FTL freight carriers with full tracking and cargo insurance included on every shipment. Risk of loss transfers to the buyer at the time the shipment is collected by the freight carrier from our facility.
The buyer is responsible for providing an accurate and accessible delivery address, ensuring a suitable receiving arrangement at the delivery location, inspecting the shipment upon delivery before signing the Bill of Lading, and reporting any visible damage or shipping errors within 24 hours of delivery. 9. Returns, Refunds & Cancellations
All sales made through Ocean Liquidation are final. Returns, refunds, and cancellations are governed exclusively by our Refund & Returns Policy, which is incorporated into these Terms by reference and available in full on our Website. The only exceptions to the all-sales-final policy are verified freight damage and major shipping errors, both of which are subject to the reporting deadlines, documentation requirements, and resolution process described in the Refund & Returns Policy.
Order cancellations are generally not accepted once payment has been confirmed. If you believe there has been an error with your order and wish to request a cancellation, you must contact us within 2 hours of placing your order at sales@oceanliquidation.com. Cancellation requests are not guaranteed to be approved. We strongly encourage all buyers to review all product listings, condition descriptions, and applicable policies thoroughly before completing a purchase.
10. Intellectual Property
All content on the Ocean Liquidation Website, including but not limited to text, product descriptions, photographs, graphics, logos, icons, button designs, page layouts, and software, is the property of Ocean Liquidation or its content suppliers and is protected by applicable United States and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use our Website for the sole purpose of browsing our inventory and placing orders in accordance with these Terms. You may not copy, reproduce, modify, distribute, publicly display, publish, transmit, sell, create derivative works from, or otherwise exploit any content on our Website without our prior written permission. Any unauthorized use of our Website content may violate copyright, trademark, and other applicable laws and may result in legal action.
11. Prohibited Uses
When using our Website and Services, you agree not to engage in any of the following prohibited activities:
Using our Website for any unlawful purpose or in violation of any applicable local, national, or international law or regulation. Attempting to gain unauthorized access to any part of our Website, our servers, or any database connected to our Website. Engaging in any conduct that restricts or inhibits any other person’s use or enjoyment of our Website, or which we determine may cause harm to Ocean Liquidation or Website users. Introducing or transmitting any viruses, malware, spyware, or other harmful or disruptive code or content to our Website. Using automated tools, bots, scrapers, or similar technologies to collect data from our Website without our prior written consent. Attempting to defraud Ocean Liquidation or any other user, including through the use of false identity information, fraudulent payment methods, or misrepresentation of business credentials. Posting or transmitting any content that is defamatory, obscene, offensive, abusive, or otherwise objectionable. Reproducing or misrepresenting our product listings, pricing, or brand identity for competitive or deceptive purposes.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Ocean Liquidation and its owners, officers, employees, agents, suppliers, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Website or Services, including but not limited to loss of profits, loss of revenue, loss of business opportunity, loss of data, loss of goodwill, or costs of procuring substitute goods or services, even if Ocean Liquidation has been advised of the possibility of such damages.
In no event shall Ocean Liquidation’s total cumulative liability to you for any and all claims arising from or relating to your use of our Website or Services exceed the total amount you paid to Ocean Liquidation for the specific order giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain types of liability, so the above limitations may not apply to you in full.
13. Disclaimer of Warranties
Our Website and Services are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied. Ocean Liquidation expressly disclaims all implied warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Ocean Liquidation does not warrant that our Website will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant that the information on our Website is accurate, complete, current, or reliable. Any reliance you place on the information provided on our Website is strictly at your own risk.
14. Indemnification
You agree to defend, indemnify, and hold harmless Ocean Liquidation and its owners, directors, officers, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses — including reasonable legal fees — arising out of or related to your use of our Website or Services, your violation of these Terms, your violation of any applicable law or third-party right, or any dispute between you and a third party in connection with merchandise purchased from Ocean Liquidation.

Our Website may contain links to third-party websites, tools, or services that are not owned or operated by Ocean Liquidation. These links are provided for your convenience only and do not constitute an endorsement, sponsorship, or recommendation of any third-party content, product, or service. Ocean Liquidation has no control over and assumes no responsibility for the content, privacy practices, or availability of any third-party website or service. Your use of any third-party website is at your own risk and is subject to the terms and conditions of that third party.
16. Governing Law & Dispute Resolution
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, your use of our Website, or any purchase made from Ocean Liquidation shall be governed by and construed in accordance with the laws of the State of Montana, United States of America, without regard to its conflict of law principles.
In the event of a dispute, we encourage you to first contact us directly at sales@oceanliquidation.com to attempt to resolve the matter informally. Most disputes can be resolved quickly and fairly through direct communication with our team. If a dispute cannot be resolved informally within 30 days of written notice, it shall be submitted to binding arbitration in Bozeman, Montana, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement or misappropriation of intellectual property rights.
Notwithstanding the above, Ocean Liquidation reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction without the requirement of posting a bond or other security.
17. Force Majeure
Ocean Liquidation shall not be liable for any failure or delay in the performance of its obligations under these Terms arising from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, storms, earthquakes, pandemics, epidemics, government actions, strikes or labor disputes, interruptions to telecommunications or internet services, freight carrier disruptions, war, terrorism, civil unrest, or any other event or circumstance outside our reasonable control. In such circumstances, our obligations will be suspended for the duration of the force majeure event, and we will use reasonable efforts to resume normal operations as quickly as possible.
18. Modifications to These Terms
Ocean Liquidation reserves the right to modify, update, or replace these Terms at any time and for any reason at our sole discretion. When we make material changes to these Terms, we will update the “Last updated” date at the top of this page. Your continued use of our Website or Services after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using our Website and Services immediately.

These Terms, together with our Shipping & Delivery Policy, Refund & Returns Policy, Condition & Grading Policy, and Privacy Policy, constitute the entire agreement between you and Ocean Liquidation with respect to your use of our Website and Services and supersede all prior and contemporaneous agreements, understandings, representations, and communications — whether written or oral — between you and Ocean Liquidation relating to the same subject matter. No waiver by Ocean Liquidation of any breach or default of these Terms shall be deemed a waiver of any subsequent breach or default.
